Weekly Comment

Irony
The United Nations recently released a report which shows the year 2006 as among the bloodiest in Iraq. It considers the deaths in Iraq, during the course of last year, to be more than 34 400, more than three times the Iraqi government's estimate.

At the same time, George W Bush; who is clearly not concerned about the view of the people in the lands he instructed his forces to occupy; who openly declares that he does not go on the opinion polls, thereby rejecting the position of the people he claims to represent; who now even opposes
the stance of the lawmakers in the country he stands as President; decided
to send 21 500 more troops to Iraq, after having stated his decision to begin proceedings for withdrawal of troops.

Polls show that Americans are overwhelmingly unhappy with Bush's Iraq
policy. Seventy percent oppose sending more troops to Iraq, as he intends
to do, according to an Associated Press-Ipsos poll last week. Bush said if a pollster asked for his opinion about Iraq, "I would be one of those that said, 'No, I don't approve of what's taking place in Iraq.'" (So, Bush disapproves of
his own Iraq policy). He said that keeping his old policies in place in the war would lead to "a slow failure," but withdrawing from Iraq, as some critics suggest, would result in an "expedited failure." "I am frustrated with the progress," the president said. "No question, 2006 was a lousy year for Iraq."
Bush, who supported and lauded the ‘execution’ of Saddam and the same verdicts for Saddam’s aides, now states that he "was disappointed and felt
like they (the Iraqis) fumbled, particularly the Saddam Hussein execution." He further stated that the unruly execution of Saddam Hussein "looked like it
was kind of a revenge killing," making it harder to persuade a skeptical U.S. public that Iraq's government will keep promises central to Bush's plan for a troop increase. He then went on to criticize the circumstances of Saddam's hanging last month, as well as Monday's execution of two top aides, including Saddam's half brother.

When is racism, racism?
During the 4th day of a cricket match between South Africa and Pakistan, Herschelle Gibbs erupted into a scene using obscenities and expletives, concluding in a racist statement.

Notwithstanding the fact that,
• The Pakistani supporter’s actions must be questioned, and the report that the Muslim supporter was drunk must be considered as a wake-up call for all Muslims,

Certain questions must still be asked:
• Is a person paid by Cricket South Africa to represent his country not a
public figure whose actions are subject to scrutiny - especially actions on the same cricket field he is representing South Africa - since he would be considered a role-model for South African youth?
• Is it really an issue whether the stump-mike was on or not? If a person
makes a racist comment to his friend, does it still qualify as a racist comment or is there a difference because it was not said publicly?
• Is it not ‘professional’ for a person paid (large sums of money) to represent South Africa, to take the heckling and teasing that ‘comes with the territory’ of being a professional sportsman, and enjoys the benefits of this position?
• Does Gibb’s comments not extend beyond racism into the realm of denigration of humanity, since he referred to humans and animals?
• How would one consider a person who responds to the actions of his antagonist, in a manner that exceeds the antagonist in the action of his antagonism?

UNICEF Report on HIV/AIDS
UNICEF recently released a report on the impact of HIV and AIDS on children, on Monday. Among the statements made in the reports are:

• The world's response to the need to protect and support HIV-infected and affected children remained insufficient.
• 15 million children under the age of 18 in the world were Aids orphans. Almost half of them were themselves HIV-positive and living in orphanages or with families chronically ill from the virus.
• An estimated 530,000 children under the age of 15 were newly infected with HIV in 2006,
• South Africa has the most Aids orphans in the world because of its denial of the pandemic, a United Nations Children's Fund report has found.

Somalia peacekeeping force
Following on the Ethiopian and US-led assault on forces of the Union of Islamic Courts in Somalia, there has been major international debate concerning the best way to solve the current crisis. Although the actions of Ethiopia and the United States should be condemned, it has emerged that an African Union led peacekeeping force will become a reality in the not too distant future. The Transitional Federal Government (TFG) of Somalia, backed by Ethiopia and US forces has taken control of Mogadishu after years of it being unable to bring peace and stability to the country. It is important not to underestimate the necessity of engaging in negotiations that include the TFG, the Union of
Islamic Courts, and other role-players in Somali politics. The President of the TFG has indicated that he is not interested in negotiating with the UIC. To
the contrary it should be noted that the TFG will ignore the UIC to its own peril, and that countries such as South Africa can play a constructive role in the peacekeeping operation if it ensures that sufficient pressure is put on
the Somali TFG, as well as other regional powers such as Ethiopia, to allow
the UIC to participate in negotiations.

Summarized Jumu’ah Bayaan:

Muharram
“The number of months in the sight of Allah is twelve (in a year): so ordained by Him the day He created the heavens and the earth; of them four are sacred; that is the correct way. So wrong not yourselves therein …”. (9:36)

 These four months, according to the authentic traditions are the months of Dhul-Qa'dah, Dhul-Hijjah, Muharram and Rajab. All the commentators of the Holy Quran are unanimous on this point, because the Holy Prophet (Sallallaahu Alayhi Wasallam) in his sermon on the occasion of his last Hajj, has declared: "One year consists of twelve months, of which four are sanctified months, three of them are in sequence; Dhul-Qa'dah, Dhul-Hijjah, Muharram, and the fourth is Rajab."

 The sanctity of these four months was recognized from the time Allah created the heavens and the earth and were prevalent in the days of Sayyidina Ibrahim (Alayhis salaam). Since the Pagans of Makkah attributed themselves to Sayyidina Ibrahim (Alayhis salaam) they observed the sanctity of these four months to the extent that despite their frequent tribal battles, they held it unlawful to fight in these four months. In the Shariah of our Noble Prophet (Sallallaahu Alayhi Wasallam) the sanctity of these months was upheld and the Holy Quran referred to them as the "sanctified months".

 The month of Muharram has certain other characteristics peculiar to it. Our Noble Rasul (SAW) said: “The best fasts after the fasts of Ramadhan are those of the month of Muharram." Although the fasts of the month of Muharram are not obligatory, yet, the one who fasts in these days out of his own will and choice is entitled to a great reward by Allah Almighty.

 It is also reported in a number of authentic traditions that in the beginning, fasting on the day of 'Ashura' was obligatory for the Muslims. It was later that the fasts of Ramadhan were made obligatory and the fast on the day of 'Ashura' was made optional. Sayyidina 'Aisha (Radhiallaahu Ánha) has said: "When the Holy Prophet (Sallallaahu Alayhi Wasallam) came to Madinah, he fasted on the day of 'Ashura' and directed the people to fast it. But when the fasts of Ramadhan were made obligatory, the obligation of fasting was confined to Ramadhan and the obligatory nature of the fast of 'Ashura' was abandoned. Whoever so desires should fast on it and any other who so likes can avoid fasting on it." (Sunan Abu Dawud). However, the Holy Prophet (Sallallaahu Alayhi Wasallam) used to fast on the day of 'Ashura' even after the fasting in Ramadhan was made obligatory. Abdullah ibn Musa (Radhiallaahu Á?nhu) reports that the Holy Prophet (Sallallaahu Alayhi Wasallam) preferred the fast of 'Ashura' on the fasts of other days and preferred the fasts of Ramadhaan on the fast of 'Ashura'. (Bukhari and Muslim)

 According to another Hadith, it is more advisable that the fast of 'Ashura' should either be prefixed or suffixed by another fast. This means that one should fast two days: the 9th and 10th of Muharram or the 10th and 11th of it. The reason of this additional fast as mentioned by the Holy Prophet (Sallallaahu Alayhi Wasallam) is that the Jews used to fast on the day of 'Ashura alone, and the Holy Prophet (Sallallaahu Alayhi Wasallam) wanted to distinguish the Muslim way of fasting from that of Jews. Therefore, he advised the Muslims to add another fast to that of 'Ashura'.

 Another tradition signifies one the feature of the day of 'Ashura. According to these traditions if one is more generous to his family on this day as compared to other days, then Allah will make the sustenance of this person more open during the entire year.

 Other virtues of the month of Muharram have also been mentioned in various traditions.

Hadith of the Week

Seek Refuge with Allah

Anâs bin Malik Radhi-Allâhu ‘anhu narrated that Allah's Messenger Sallallâhu 'alayhi wasallam used to say:
"O Allah! I seek refuge with You from incapacity and laziness, from cowardice and geriatric old age, and seek refuge with You from the punishment of the grave, and I seek refuge with You from the afflictions of life and death." (Sahih Al-Bukhari Vol. 8 : No. 378)

Quotation for the Week

Friendship

If you are proud of your courage, remember those who are more valiant than you. Then examine what you do with your courage that Allah has bestowed you
with. If you waste it in rebellion against Allah, you are a fool for you are losing your soul by committing acts that has no value. If you use your courage
in obedience to Allah, you are spoiling it by your pride. You should always remember that courage will fall away as you
grow old and if you live long,
you will become dependant and as weak as a baby.”
Ibn Hazm Al-Andalusi in Al-Akhlaaq wa al-Siyar

Point of Reflection

Possibilitarian

Become a ‘possibilitarian’. No matter how dark things seem to be or actually are, raise your sights and see possibilities - always see them, for they are always there.

Q and A

Question:
I am married to my second
cousin. I now also intend to
marry my first cousin. However, my wife is the niece of the
woman I want to marry.
Answer:
It is not permissible for you to
be married to an aunt and niece
at the same time. Only if the marriage between yourself and
your present wife comes to an
end, through death or divorce,
will it be permissible for you to marry the aunt.

The general rule is that if the relationship between the two women is such that if one of
them were a male it would not
be permissible for them to have married one another, then for a man to have both of these
women in his nikah at the same time is not permissible.
(Shaami, vol.3 p.38/39).

And Allah Ta'aala knows best.

Tasheel Series of Text Books

Some years ago the Jamiatul Ulama prepared a set of text-books for the teaching of Islamic Studies in madaaris. The text-books gained much popularity and were used extensively. The series, called the Tasheel Series, was however the first edition of the complete set
of textbooks which covered a
range of subjects for students
from grade 1 to 12.

The Jamiatul Ulama then engaged
in a programme of vigorously obtaining feedback from teachers students, parents and experts regarding the text-books. A
process of sorting and evaluating the feedback was then engaged
in. The final process included revising both the content and design of the text-books and additional teacher resources,
after which it was tested as a pilot project in various madaaris.

Alhamdulillah, the New Tasheel Series for grade 1 to 5 is now complete and available from the Jamiatul Ulama Offices in Johannesburg. The current text-books include individual textbooks for Qur’anic recitation, Hadeeth, Fiqh, Aqaaid, Akhlaaq and Aadaab, and Ad`iyyah.

The Tasheel Series is currently being used by schools around
South Africa and it’s neighbouring countries, Malawi, USA, UK, Thailand, the Middle-East and
India.

Message from the Ameer of the Jamiatul Ulama

A New Year

As is traditional at this time of the year, when everyone gets back to their workplace or offices, resolutions are made. As mu’mins (believers), we must not focus only on worldly targets and ambitions, but also on higher spiritual aims.

Achieving aims depends upon having a firm intention and a strong will. Whoever loses these two will never attain
his goals. When one’s intention is firm, he adheres to his plan, whereas if the intention is not strong and clear
then there is every chance that he may lose his way. If one’s will is strong, the servant of Allah will walk along the right way that leads to that aim with confidence. Having a strong will opens the way and a resolute intention focuses one on the aim. If one’s aim coincides with the way that reaches to it, one will be successful. Thus, the road and the direction should be correct. One supplements the other.

Most importantly all resolutions, whether apparently worldly or purely spiritual, must be aimed at ultimately obtaining the pleasure of Allah, since the purpose of mankind is that of worshipping the Almighty Allah (azza wa jalla), and thereby obtaining His pleasure.

On the occasion of the beginning of the new Islamic year, it also appropriate to remind ourselves of the hijrah of the Prophet Sallallâhu 'alayhi wasallam and learn lessons from this most important event.
