Xenophobia
Muslims stand united
under the banner of ‘Laa
ilaaha illallaah’.
Gender, race,
nationality or ethnicity
cannot, and must not, be
a cause for creating
disunity, fragmentation
or strained
relationships between
the members of
the Brotherhood of
Believers.
Political changes, post
1994, in South Africa
have brought about many
changes. With South
Africa being welcomed
into the mainstream
international political
community, the
reciprocal opening of
it’s borders to people
from outside South
Africa also came into
effect. Large numbers of
foreigners from a
variety of countries
were thus attracted to
the shores of
our beautiful land.
The ever growing influx
of Muslims from other
lands presented a novel
scenario to the South
African Muslim
Community. Some people
responded
with an open heart, some
with a warm welcoming
arm, some with cautious
suspicion, some with a
sceptical welcome and
some with open
hostility.
When the Prophet
Muhammad (sallallahu
`alayhi wa sallam) came
to Madinah, among the
first thing he did was
to establish a
brotherhood between the
Muhaajiroon and the
Ansaar. The people of
Madinah responded to the
hijrah of those from
Makkah with open arms,
and welcomed them into
their homes and hearts,
willing to share
everything they had with
them.
Muslims of South Africa
need to respond to the
coming of their brothers
in
an appropriate manner.
The unscrupulous moral
and social conduct of
some of the foreign
brothers must be dealt
with since it can cause
the negative profiling
of the entire Muslim
community. At the same
time we should not
negatively profile all
foreigners.
Programmes for forging
better relationships and
stronger bonds between
all members of the
Muslim community must be
worked on. We need to
look at:
Opening channels of
communication between
leaders of respective
communities.
Creating databases of
all Muslims in each
area.
Establishing places of
prayer in respective
areas.
Inviting scholars from
different sectors of the
community to address the
joint congregations.
Making all sectors part
of the decision making
process.
We need to approach the
integration of migrant
Muslim Communities based
on the ideal that “All
Believers are but
brothers and sisters
unto one
another”. Let us
discharge our obligation
to our brothers and
sisters by
really making them a
part of the broader
Muslim Community. The
month of Ramadan
presents us with an
added opportunity to
begin afresh in a
blessed month.

CONDITIONS OF ZAKAAT:

|
Scholars have
established specific
conditions or
requirements for Zakat
to become incumbent on
an individual. Some of
these conditions are
related to the person
that pays the Zakat and
others to the property
itself: |
ISLAM
Zakah is only incumbent
on Muslims. |
TAKLEEF (Legal
Competency for
Obligation)
Some scholars have
placed the conditions of
buloogh (reaching the
age of puberty) and
sanity (intellectual and
emotional stability) for
the mandate of zakah.
They said that, "zakah
is not mandatory on the
wealth of those who
are not mukallaf
(competent persons
obligated to observe the
precepts of religion." |
INTENTION
The validity of zakah
depends upon the
expression of one's
intention.
The one paying the zakah
should pay it to its
recipients, believing
that it is
an obligation to be
incumbent on the
individual. Therefore,
it should be associated
with intention. |
COMPLETE POSSESSION
OF WEALTH
The real owner of the
wealth is Allah and
Allah has, out of His
Grace and Generosity,
granted man succession
to it. He has entrusted
man with it so
that man can use it and
dispose of it according
to the Law of the Real
Owner. Allah says, "And
give them something out
of the wealth of Allah
which He has bestowed
upon you." [24:3] He
also says, "Believe in
Allah and His Messenger,
and spend of that
whereof He has made you
trustees." [57:7] |
The meaning of complete
possession of wealth, in
this instance, is that
the wealth is within the
hands of a particular
person and that such
wealth is free from any
rights by others. This
person has the right to
dispose of and use the
wealth as he wills. He
must have the
possibility of
benefiting from his
possession and must be
personally designated.
Two important concerns
should be noted
regarding this
condition: |
The money is
designated to its
owners. This meaning
is indicated in many
verses in the Qur'an
among which are the
following: "Take from
their wealth
a sadaqah ..." [9:103]
and "And those in whose
wealth there is a known
right
for the needy who ask,
and for those who are
deprived (of wealth)."
[70:24-25) This
designation suggests
possession. They may use
and dispose of their
wealth, as they will. |

Zakah is to give
possession of the wealth
to its recipients. In
order to do so, the
person should possess
the wealth. How can a
person give away money
to others that does not
belong to him? There are
also other circumstances
and conditions under
which, a person's wealth
or a portion thereof, is
not liable for zakah. |
WEALTH WITH NO OWNER:
Such as the moneys
of the state collected
by zakah, taxation or
other sources. There is
no zakah on these moneys
because they belong to
the entire community,
including the poor. |
WAQF (endowments) of
a public sector:
Moneys from sources such
as
masajid, fighters in the
path of Allah, orphans,
schools, etc., are not
subject to zakah
according to sound
opinions. Nor is the
one-third or less
portion
from the will of the
deceased. |

wasallam said, "No fatigue,
nor disease, nor sorrow, nor
sadness, nor hurt, nor
distress befalls a Muslim,
even if it were the prick he
receives from a thorn, but
that Allah expiates some of
his sins for that." (Sahih

Q:
Is it permissible to use
mouthwash while fasting?
|
A: It is Makrooh
(undesirable)
to use mouthwash while
fasting.
If however some of the
mouthwash does happen to go
down the throat the fast
will break
(Aap Ke Masaa’il).
According to the Mazhab of
Imam Abu Hanifah
rahmatullahi alaih it is
Sunnah to use the Miswaak to
clean the teeth
while fasting. One should
rather use the Miswaak as
this will
serve a dual purpose. It
will
clean the teeth and one will
be rewarded for using it.
And Allah Ta'aala knows
best. |
Q: Can a person use an
inhaler during fasting? What
happens
in the case that he cannot
do without the inhaler for
the duration of the fast? |

A:
No, it is not permissible to
use inhalers during fasting.
One should use them just
before fasting and
immediately when breaking
the fast. However, if one
can not do so, i.e. one is
so dependant on it that one
requires to use it every few
hours and without it one
experiences severe attacks
then in this case one will
be permitted not to fast but
when the person is
completely cured
of this ailment then Qadha
should be kept for all the
missed fasts. If there is no
hope of him being cured then
Fidya should be given in
lieu of every fast missed.

the South African National
Halal Association was held
in Cape Town last weekend.
Over 120 persons attended.
Reports were presented and
elections held. Great
interest was shown by Ulama
and the general public, and
committed participation
resulted in healthy
discussion. |

Darul Ulum Azaadville Jalsah
The Darul
Uloom Madrassah Arabia
Islamiayah (Azaadville) will
be holding it’s annual
Graduation and Khatm al-Bukhari
Jalsah on Friday, Saturday
and Sunday (21, 22, 23
Sha`baan 1427). The Jalsah
will take place at the Darul
Uloom.

the Jamiatul Ulama |
On the
doorstep of Ramadaan
On the last day of one
Sha'ban, Prophet Muhammad
Sallallahu 'alayhi wasallam,
gave a Khutbah about the
upcoming month of Ramadan.
It is a very important
Khutbah that we should
carefully read before every
Ramadan to prepare ourselves
mentally for the sacred
month.
"Oh people! A great month is
coming to you. A blessed
month. A month in which
there is one night that is
better than a thousand
months. A month in which
Allah has made it compulsory
upon you to fast by day, and
voluntary to pray by night.
Whoever draws nearer to
Allah by performing any of
the voluntary good deeds in
this month shall receive the
same reward as is there for
performing an obligatory
deed at any other time. And
whoever discharges an
obligatory deed in this
month shall receive the
reward of performing seventy
obligations at any other
time.
It is the month of Sabr
(patience), and the reward
for sabr is Heaven. It is
the month of kindness and
charity. It is a month in
which a believer's
sustenance is increased.
Whoever gives food to a
fasting person to break his
fast, shall have his sins
forgiven, and he will be
saved from the Fire of Hell,
and he shall have the same
reward as the fasting
person, without the latter's
reward being diminished at
all." [Narrated by Ibn
Khuzaymah]
In addition, Allah's Apostle
said, "When the month of
Ramadan starts, the gates of
the heaven are opened and
the gates of Hell are closed
and the devils are chained."
[Sahih Al-Bukhari]
Narrated Abu Huraira (r.a):
The Prophet said:"...
whoever fasts during Ramadan
out of sincere faith and
hoping to attain Allah's
rewards, then all his past
sins will be forgiven." [Sahih
Al-Bukhari]
"Ramadan is the (month) in
which the Quran was sent
down, as a guide to mankind
and a clear guidance and
judgment (so that mankind
will distinguish from right
and wrong)" [Quran 2:183]
"Oh you who believe! Fasting
is prescribed to you as it
was prescribed to those
before you, that you may
learn piety and rightousness"
[Quran, al-Baqarah, 2:183]
Let us take the opportunity
of obtaining our maghfirat
and obtaining a high rank in
the sught of Allah during
this month – it is truly a
gift to all Muslims. |
